Key Insight: Court denied plaintiff?s motion to compel inspection of third party?s electronic records where the subpoenas seeking access was overly broad, where the existence of additional responsive information was speculative, where the information sought was cumulative of information obtained elsewhere, and where conducting the requested search would result in a significant burden to a non-party

Race Tires Amer., Inc. v. Hoosier Racing Tire, Corp., 674 F.3d 158 (3d Cir. 2012)

Key Insight: On appeal, the Third Circuit vacated the District Court?s approval of taxable costs related to electronic discovery and remanded with instruction to re-tax in accordance with this opinion. Specifically, the court concluded that the relevant vendors? charges ?would not qualify as fees for ?exemplification?? and that ?of the numerous services the vendors performed, only the scanning of hard copy documents, the conversion of native files to TIFF, and the transfer of VHS tapes to DVD involved ?copying?? and were thus recoverable.

Key Insight: Finding that the alleged spoliator had no notice of the potential relevance of the allegedly spoliated data and that the information?namely maintenance records?was available elsewhere, court concluded that he moving party failed to establish that the data at issue was ?crucial? to its case and denied motion for sanctions

Pouncil v. Branch Law Firm, No. 10-1314-JTM-DJW, 2012 WL 777500 (D. Kan. Mar. 7, 2012)

Key Insight: Where evidence indicated that defendant?s responses to discovery were incomplete, court ordered defendant to ?proceed with the forensic search of their computer systems using protocols agreed upon by the parties? but declined to compel defendant to bear the cost of the examination until final costs were known; defendant was also ordered to institute a litigation hold where defendant?s deposition testimony established that none had previously been issued

Dent v. Siegelbaum, No. DKC 08-0886, 2012 WL 718835 (D. Md. Mar. 5, 2012)

Key Insight: Court did not err in denying plaintiff?s request for a spoliation instruction with respect to digital pictures taken of plaintiff which were deleted when a defendant (a police officer) connected the camera to his computer for uploading where there was no evidence ? to prove, or even suggest? that the officer intended to destroy the pictures and where ?a culpable state of mind? was a necessary element to be proven by a party seeking such sanctions

Key Insight: Court granted motion to allow forensic imaging of plaintiff?s computers for purposes of discovery where plaintiff?s production of ESI was very small, where plaintiff?s CIO admitted he had taken no efforts to retrieve any ESI, and where it was established that ESI may be present on plaintiff?s computers?possibly including electronic copies of hard copy documents which may have been shredded; court?s order called for court-appointed forensic expert to conduct examination and established other protocols to be followed

Moore v. Gilead Sciences, Inc., No. C 07-03850 SI, 2012 WL 669531 (N.D. Cal. Feb. 29, 2012)

Key Insight: Court granted in part defendant?s motion for sanctions and ordered an adverse inference where the court determined plaintiff had a duty to preserve and that the deliberate wiping of his hard drive was in bad faith but declined to impose monetary sanctions or dismissal where plaintiff?s actions were not found to be sufficiently egregious, where plaintiff was forthcoming about the spoliation and his reasons (to protect personal and privileged information contained on the work-issued laptop), and where defendant had a substantial amount of the deleted material on backup tapes, etc. because of its backup practices

General Elec. Co. v. Wilkins, No. 1:10-cv-00674, 2012 WL 570048 (E.D. Cal. Feb. 21, 2012)

Key Insight: Addressing whether GE would be required to restore, search, and produce responsive contents of hundreds of backup tapes, court found that the data on the backup tapes was not reasonably accessible because of the significant expense of restoring and searching the tapes and further found that defendant did not show good cause to compel restoration and production, particularly where defendant failed to provide any evidence of the presence of unique, responsive documents on the tapes

Robinson v. City of Arkansas, Kansas, No. 10-1431-JAR-GLR, 2012 WL 603576 (D. Kan. Feb. 24, 2012)

Key Insight: Addressing the sufficiency of defendant?s search for responsive ESI, among other discovery disputes, court found that defendant failed to conduct a reasonable search and ordered additional searching as specified by the court and that defendant produce mirror images of the computers and external drives of a former supervisor for defendant that was particularly relevant to the litigation (the court called the failure to search his computers ?inexcusable and inexplicable?); court granted protective order precluding defendant?s expert from requirement to produce hardware (computers, etc.) already subject to production by defendant pursuant to court?s order where such duplication was unnecessary and would unnecessarily increase costs

Key Insight: Court granted defendant?s motion to compel production of ?computer images and dumpster files? for 29 custodians upon finding that the information sought was relevant and that production would not be unduly burdensome
